Background of the Study
International legal instruments are essential for safeguarding vulnerable populations, particularly refugees. The 1951 Refugee Convention stands as the cornerstone of refugee protection, establishing rights for displaced persons and obligations for signatory states (Evans, 2023). In Rivers State, where refugee influxes have impacted social and economic conditions, this Convention has guided national policies on asylum and human rights protection. The study examines how the legal framework provided by the 1951 Refugee Convention is implemented locally, its impact on the protection of refugees, and the challenges encountered in adapting international norms to local realities (Foster, 2024). It investigates policy adaptation, judicial interpretations, and the role of governmental and non-governmental organizations in enforcing refugee rights. The research also considers criticisms regarding the Convention’s limitations in addressing contemporary migration challenges, such as protracted displacement and urban refugee integration (Garcia, 2025). By analyzing legal texts, case studies, and stakeholder interviews, the study seeks to provide a comprehensive evaluation of the Convention’s effectiveness in Rivers State.
Statement of the problem
Although the 1951 Refugee Convention provides robust legal protection, its implementation in Rivers State faces significant obstacles. Challenges include limited resources, bureaucratic inefficiencies, and difficulties in aligning international standards with local socio-political contexts (Evans, 2023). Critics note that despite the Convention’s mandates, refugees in Rivers State often encounter inadequate protection and support, leading to humanitarian and social issues (Foster, 2024).
